Driving under the influence, or while intoxicated, is a very serious offense and is punishable in all fifty states. There are, of course, different consequences for each state, but each of them has a "per se" law making it a crime, and requiring a Legal DUI Punishment for drivers under the influence.
Some states have harsher laws than others, but there is always a blood alcohol content level that is set, and if a driver is at or above that level, they are considered to be driving under the influence. If you are found in violation of the laws, or if you refuse to take a sobriety test, you will most likely be taken into custody, and brought to the police station. You will usually be kept in custody until someone can come and pick you up, or until you have completely sobered up.
After you have been taken into custody for a DUI, you will most likely have your license confiscated and temporarily suspended, and if there is no one to take your vehicle home, your vehicle will be impounded as well. As in any criminal case, you will have the right to a trial, but in the end, a judge will decide your fate. If you are found guilty a judge may order minor consequences such as;
- Suspending or revoking your drivers license
- Imposing fines or driver responsibility tax

- Requiring you to enroll in drunk driver education, or drug treatment program

A judge may also sentence you to jail or require that you perform community service for your actions. There is always the possibility that if you are faced with your first DUI, the judge may be lenient and require parole or probation, depending on the state you live in. While on probation you may still be required to attend drug and alcohol classes, and may be prohibited from drinking any alcohol or even entering a drinking establishment until your sentence is completed.
In general, when you are arrested for your first DUI you will most likely face the minimum punishment, if no one else was injured due to your actions. The consequences become more and more serious if you continue to drive under the influence, and continue to be arrested. Mainly because if you have already been put on probation, you are likely drinking when you are not supposed to be, and driving with a suspended license. After the first offense, a judge is going to lose patience and compassion for you and your situation, and a jury is likely to feel the same way.
Legal DUI punishment is necessary and gets more severe every time you decide to drive under the influence. Not only are you risking your own safety, but you are also risking the safety of innocent people on the road. These punishments are in place to keep people from making the same mistakes again and again, and hopefully if you are unfortunate enough to be involved in a criminal case such as this, it will be a one time mistake.
